MUSIC SUBMISSION POLICY

Submit Original Hi-Quality Audio/Video w/Correct MetaData (+ contact info)

* Submission is FREE – We reserve the right to select featured artists.
By submitting your music, you agree to the 805 HEAT WAVZ BRAND terms & conditions listed below.

**805HEATWAVZ.COM TERMS AND CONDITIONS**

**1. DEFINITIONS**
* “Website” means 805HEATWAVZ.COM and related services.
* “User” means anyone submitting content or using Website.
* “Content” means music, images, videos, text submitted or posted.

**2. GOVERNING LAW**
* These Terms shall be governed by California laws.

**3. SUBMISSION TERMS**
* User retains copyright to Content submitted.
* By submitting Content, User grants 805HEATWAVZ.COM non-exclusive license to:
+ Host, play, stream, and promote Content on Website and affiliated channels.
+ Use Content for promotional purposes – including social media and advertising.

**4. REPRESENTATIONS AND WARRANTIES**
* User warrants Content submitted is original or properly licensed.
* User agrees Content doesn’t infringe copyrights, trademarks, or rights of others.

**5. DELIVERY FORMAT SPECIFICATIONS**
* For Live365 805HEATWAVZ Station rotation:
+ Submit music in MP3 format, 320kbps bitrate, with complete ID3 tags.
* For 805HEATWAVZ.COM exclusive content:
+ Submit music in WAV format (16-bit, 44.1kHz preferred) – including:
– Main Track
– Instrumental Track (optional)
– Acapella Track (optional)
– Studio Stem Files (optional) – drums, bass, melodies, harmonies, FX
* For music video submissions:
+ Submit videos in MP4 format, HD resolution (1280×720 pixels or higher)
+ File size limit temporarily set to 500MB
+ Accompanying audio file (WAV format, 16-bit, 44.1kHz preferred)
+ Video metadata including artist/band name, song title, album title (if applicable), director/producer credits (if applicable)

**6. DERIVATIVE WORKS PERMISSION**
* By submitting music or video, artists grant permission to create derivative works:
+ Featuring submitted tracks/videos in 805HEATWAVZ.COM playlists
+ Sharing audio/video clips on social media platforms
+ Potentially embedding videos in website articles/features
+ Documentary films/projects (including Hip-Hop documentaries) produced by 805HEATWAVZ.COM or affiliated entities
* These derivative works may be:
+ Offered as FREE downloads
+ Sold as paid downloads – with no additional royalty obligations beyond initial submission terms.

**7. DOCUMENTARY FILM/PROJECT USAGE**
* Submitted content used in documentaries remains non-exclusive – artists retain original rights.
* 805HEATWAVZ.COM agrees to provide fair attribution – crediting artists in documentary credits/end titles.
* 805HEATWAVZ.COM retains no rights to profits or ownership of documentaries produced using submitted content – **all profits and ownership belong exclusively to the documentary producer**.
* Submitted content providers waive any claim to documentary profits, royalties, or residuals – granting producer full financial rights.

**8. MUSIC USAGE AND PROMOTIONAL PERMISSION**
* By submitting music, you also grant 805HEATWAVZ.COM permission to:
+ Play your tracks on our live broadcasts without prior notification
+ Use your music in various promotional formats, including but not limited to:
+ Website features – Social media posts – Video clips (e.g., YouTube) showcasing our brand and station
+ Collaborative playlists with other platforms
+ Represent your music under the 805HEATWAVZ.COM brand name, as well as the DJ Heat Wavz brand name, for the purpose of promoting our station, website, and all other services provided by the 805 Heat Wavz Brand and the DJ Heat Wavz Brand Name
+ Extend permission to authorized:
+ DJs – Podcast hosts – Content creators hosting shows, broadcasts, or promoting on our behalf, via our website or their own social media/profiles, to use submitted music in their live mixes, promotional clips, or posts, as long as such content links back or attributes to 805HEATWAVZ.COM

**9. ROYALTIES AND PAYMENT**
* 805HEATWAVZ.COM assumes no royalty payment obligations for submitted Content – unless separately agreed upon.

**10. CONTENT REMOVAL AND REJECTION**
* 805HEATWAVZ.COM reserves right to remove or reject submitted Content at discretion.

**11. WEBSITE USE AND LIABILITY**
* User agrees to use Website lawfully and respectfully.
* 805HEATWAVZ.COM disclaims liability for damages arising from Website use or submitted Content.
